    1. Prior information

    These Terms and Conditions will regulate the purchase and sale of the products that ARZANO, S.L. (hereinafter, “RENATTA & GO”) markets through the site https://www.renattandgo.com/ (hereinafter, the “Website”).

    2. Acceptance of the Terms and Conditions and access to the Website

    When using the services of the Website, the user (hereinafter, the “User” or “Users”) accepts these Terms and Conditions which define the rights and obligations of RENATTA & GO and the user regarding the contractual relationship that derives from the use of the products and services accessible through the Website.

    These are the only Terms and Conditions applicable to the use of the Website (without prejudice to the fact that for certain services there may be particular conditions) and to the contracting of orders through the Website and they replace any other conditions.

    3. Purpose

    This Website has been developed by RENATTA & GO with the purpose of offering Users the purchase of products related to women's clothing and accessories (hereinafter, the “Products”).

    When choosing RENATTA & GO Products, the User must choose the corresponding design. The purpose of these general conditions is to regulate the sale of these Products to Users.

    4. Creation of a user account and information requested from the User

    Users, to be able to access the products or services offered by RENATTA & GO, must register through the Website by creating a user or guest account.

    In this sense, the User will select a username and password, committing to make diligent use of them and to not make them available to third parties, as well as to notify RENATTA & GO of the loss or theft of them or the possible access by an unauthorised third party, so that they can proceed to immediately block your account.

    Users must indicate their data in an exact, true, up to date and complete manner, as requested in the section of the registration form for account creation, as well as in the order section for a product/s of the Website.

    5. Website use

    Users pledge to make lawful, diligent, honest and correct use of any information or content they have access to through the Website. This is done under the principles of good faith and respecting current legislation and these Terms and Conditions at all times.

    RENATTA & GO reserves the right to deregister those Users who are misusing their account, carrying out fraudulent acts or acts that may harm RENATTA & GO.

    In the event that RENATTA & GO detects any anomaly or there are justified reasons to believe that a User is carrying out any fraudulent acts that contravene good faith and these Terms and Conditions, RENATTA & GO reserves the right to deregister said User, including all those Users who have benefited directly or indirectly from this type of action, and may also exercise all legal actions that may apply.

    In this sense, RENATTA & GO declares that it has enabled the appropriate mechanisms to detect any possible fraudulent, anomalous or malicious action that seeks to alter the general conditions of use of the account by Users.

    RENATTA & GO reserves the right to refuse an account when it has reasonable and justified grounds to believe that a User has violated these Terms and Conditions.

    6. Orders and sale conditions

    RENATTA & GO places orders throughout the whole of mainland Spain, the Balearic Islands, as well as all countries belonging to the European Union.

    In this sense, RENATTA & GO will inform the User of all costs and expenses (transport costs, tariffs/taxes, etc.) that may be incurred as a result of placing the order, whether at a national or European level, and they will be calculated at the time of finalising the basket or quote (since they are calculated by the weight of the products and the delivery address).

    These expenses will be chargeable by the User themselves, exempting RENATTA & GO from paying or crediting any cost related to this notion, except for shipments to the store and to home addresses in mainland Spain with an amount of more than 70 Euros, in which case, it will be RENATTA & GO that will be chargeable with them.

    To make a purchase, Users must complete the order form on the Website.

    As a general rule, RENATTA & GO will not intentionally put more units on sale than it has available, unless it is a pre-sale and RENATTA & GO has been notified as such.

    However, situations may arise in which a User proceeds to purchase a quantity of items or a specific item that, at that moment, is not physically in RENATTA & GO's stock and that, therefore, cannot be delivered to the User immediately.

    In these cases, RENATTA & GO may contact the User, informing him/her of the unavailability of the quantity of the product or products requested and that, for this reason, the receipt of the items could be delayed, specifying the approximate date of delivery and confirming with the User if he/she wants, in any case, that:

    1. RENATTA & GO will proceed to send him/her the quantity of products that are actually in stock and cancel the part of the order that is not available,

    2. the possibility to cancel the order in its entirety, or

    3. the possibility to wait for all the products in their order to be available in stock.

    Taking into account the above, RENATTA & GO can likewise, at the request of the User:

    1. Send all products together, from the moment these out-of-stock products are available again,

    2. proceed with a partial shipment of the products available at that time, and send the rest of the order when the others are available, with clear mention of the additional transportation costs that could arise,

    3. propose an alternative product/s of equivalent quality and price, accepted by the User, or

    4. in the event that the User decides to cancel their order for products that are not available in stock, they will receive a refund of all sums paid for said products as soon as possible.

    7. Prices and ways to pay

    Once the products have been selected and saved in his/her shopping basket, the User must click on the basket, verify that the content of the order is correct and proceed to pay for the selected products. In this regard, so that the User can proceed to pay for their order, and if at the time of the purchase form they have not done so yet, the User will be invited to sign in or register through the Website’s registration form as a “User” or as a “guest”.

    Taking into account the above, all prices of the Products indicated on the Website are shown in Euros and include VAT and other taxes that may apply.

    Regarding the payment method, the User may pay the amount corresponding to their order using the payment methods accepted on the Website. The specific payment methods accepted are:

    • Bank card: the amount indicated in the order will be applied. Card payment will not be accepted if it exceeds €999.
    • Paypal: the amount indicated in the order will be applied. Payment with Paypal will not be accepted if it exceeds €999.
    • Pay Later with Sequra (up to 7 days after shipping).
    • Pay in 3 instalments at no extra cost or in 6, 9, 12 or 18 months for only a small cost per month with Sequra.

    In this regard, RENATTA & GO will not send any order confirmation by post.

    Users are guaranteed that the payment process is carried out with absolute security, in accordance with the required security protocols and services.

    The User must notify RENATTA & GO of any improper or fraudulent charge on the card used to make the purchases, by sending an email to the following email address: customerservice@renattandgo.com, in the shortest period of time possible so that RENATTA & GO can take the appropriate steps in relation to the specific matter.

    Payment conditions with SEQURA:

    • Pay Later (up to 7 days after shipping):

    Receive your order and try it on easily before paying. When your order leaves the store, we will notify you and you will have 7 days to try on and pay, without additional costs.

    7.1. – Shipping costs

    Regarding shipping costs, the User must take into account that all amounts specified in this section are estimates, and this is because, in addition to the delivery address, shipping costs will depend on the weight of the package, packaging or the courier/mode of transport chosen, as well as the distance to the collection point from the warehouse from which the product is sent.

    In this regard, RENATTA & GO will always inform the user of all information related to any extra cost that may occur in said shipment, as well as in relation to the estimated delivery times.

    8. Information about RENATTA & GO Products and services

    The information included on the Website in the descriptions of the Products has a purely informative function.

    Therefore, RENATTA & GO doesn’t accept any responsibility for the appearance of errors in said information, although it undertakes to take all measures within its power to correct the aforementioned errors or omissions as soon as possible after being informed of them.

    9. Delivery times, place of delivery and losses

    9.1. Product delivery

     

    RENATTA & GO undertakes to deliver the Product in perfect condition to the address indicated by the User. In order to optimise delivery, the User must indicate an address to which the order can be delivered during normal working hours.

    In this sense, and in accordance with the provisions of article 123 of Royal Legislative Decree 1/2007, of November 16 (hereinafter, “Consumers and Users Law”) in the case of fragile products or products of a similar nature (such as, for example, a glass item or a particularly delicate fabric or accessory), the user must report any damage to the product within 24 hours of receipt at the delivery address that the User has specified in the order purchase form. If this communication does not occur within the aforementioned period, RENATTA & GO will not be responsible for said damages and the User will not have the right to a refund.

    On the other hand, RENATTA & GO will not be responsible for errors caused in the delivery of the order when the delivery address entered by the User in the order form is imprecise, does not correspond to reality, is false or has been omitted.

    Without prejudice to the above, RENATTA & GO undertakes to adopt those measures within its reach, so that the delivery of orders can be made within the agreed time, and if not, as soon as possible, to the satisfaction of the recipient.

    Finally, home delivery will only be attempted once. That is, in the event that the User is not at home at the time of delivery, said order will be sent to the delivery point or parcel shop that, according to the criteria of the logistics operator, is the most convenient according to the delivery address that the User has indicated.

    In the event that the logistics operator informs RENATTA & GO of the lack of information necessary for home delivery, or that the information provided by the User is incorrect, RENATTA & GO may contact the User directly through the telephone number or email indicated in the registration form and will request the information that is pertinent for the correct shipping and delivery of the order.

    9.2. Delivery time and notification

    On the other hand, regarding the delivery time, the User must take into account that all the dates specified in this section will be of an estimated nature, so RENATTA & GO will not assume any responsibility in case of non-compliance with the delivery estimate of the purchased product.

    Notwithstanding the foregoing, in the event that RENATTA & GO has not delivered the order after 30 days from the agreed delivery date, due to lack of availability of the product or service, the User must be informed and will be entitled to cancel the order, and receive a refund of the total amount paid at no extra cost, without resulting in any liability for damages attributable to RENATTA & GO.

    The order will begin to be prepared within 2 business days following confirmation of the order and the delivery time is usually between approximately 2 and 7 business days, depending on the destination and the chosen payment method. This term is understood provided that the availability of the merchandise has been confirmed and full payment of the order has been verified.

    In the event that the User is not present at the address indicated in the registration form, their order will be sent to the delivery point or parcel shop that, according to the criteria of the logistics operator, is the most convenient according to the delivery address indicated.

    The User must take into account that on certain dates and during certain periods of the year, the delivery time of shipments (such as, for example, during the Christmas season, on Black Friday, etc.) could be affected by the demand for more means of transport. Therefore, it is recommended to reserve and/or purchase the items of interest sufficiently in advance so that they arrive at their destination on the dates desired by the User.

    RENATTA & GO informs you that it will not make deliveries on Saturdays and Sundays or on national or community holidays, nor on those days that coincide with local holidays that could affect related transportation activities. 

    The delivery will be considered complete when the carrier has handed over the products to the User and the User, or his/her delegate, has signed the delivery receipt document.

    In the event that the User collects the product purchased from a RENATTA & GO physical store, the User will have 10 days to proceed with the collection, starting from the moment RENATTA & GO informs them via email that the product is now in store.

    9.3. Diligence in delivery

    The User must check the condition of the package with the courier that delivers the requested Product.

    If the User detects any problem with the Product, he/she must indicate it on the delivery note and in turn notify RENATTA & GO by email at the following email address: customerservice@renattandgo.com.

    10. Exchanges, returns and right of withdrawal

    10.1. Returns due to manufacturing defects

    All products offered through the Website will be completely original, unless otherwise indicated in their description. Likewise, all of them will have a guarantee period of 3 years from receipt of the product, in accordance with the criteria and conditions described in the Consumer and User Law, which approves the consolidated legislation of the General Law for the Defense of Consumers and Users and other complementary laws that may be applicable. This guarantee will be provided by the product supplier.

    In this regard, during the warranty period, RENATTA & GO will be responsible for the expenses that may be incurred due to the collection of the returned product (such as, for example, transportation expenses). 

    Taking into account the foregoing, it will be understood, unless proven otherwise, that the products are in accordance with the contract as long as they meet all the requirements expressed below:

    1. They conform to the description made by RENATTA & GO and possess the qualities of the product that RENATTA & GO has presented to the user;

    2. are suitable for the uses to which products of the same type are ordinarily intended; and

    3. present the usual quality and performance of a product of the same type that the User can reasonably expect, taking into account the nature of the product.

    RENATTA & GO customers benefit from the guarantee given by the different manufacturers of each of the items. Defects or damages due to incorrect use or handling of the material or wear and tear caused by its use are not included in this warranty. Decreases in the functionality of the items, due to limitations in their design, are also not covered in this guarantee.

    That is why the User must send RENATTA & GO images that demonstrate the manufacturing failure or defect in the Product to the email address customer@renattandgo.com, with RENATTA & GO proceeding in these cases to manage the collection, free of charge, and to send a Product of the same design and size (if it is available in stock at that time), provided that the User agrees to proceed in this way. Should the User not want to receive another product with the same characteristics or said product does not exist in stock, RENATTA & GO will proceed to refund the purchase amount to the User.

    During the warranty period, the User may return to RENATTA & GO, free of charge, any product that they have purchased but wish to have a refund.

    10.2. Returns

    For those cases, in which the User is simply not satisfied with the requested order, and when the order has been purchased online, the User may:

    Request a full refund of the amount paid by the User for the returned product.

    For cases in which the User has purchased the product in physical stores, in corners of shopping centres or in other marketplaces, the return policy will be the one that governs each of these establishments. Furthermore, should RENATTA & GO allow the User to make an exchange of the product purchased on the website for another product purchased in a physical store, the return policy will be governed by that of the store.

    10.3. User right of withdrawal

    The User will have a period of fourteen calendar days to make returns, exercising his/her right of withdrawal, from the date of material acquisition of the product, without any penalty and RENATTA & GO will be responsible for the cost derived from the withdrawal exercise on the part of the User, in accordance with the provisions of the Consumer and User Law. 

    To formalise the return, the User must complete and send the withdrawal form to the email address customerservice@renattandgo.com, which is found at the end of these Terms and Conditions, detailing the product or products to be returned with a brief description.

    Once this communication is received, the RENATTA & GO customer service team will inform you of your request number and how to proceed to return the product.

    Each product to be returned must be in perfect condition, unused and with all its labels, packaging and, where applicable, documentation and original accessory elements that were included with it.

    Once the product is received, RENATTA & GO will proceed to refund the amounts paid by the User that correspond to that product as soon as possible and, in any case, within fourteen (14) days following receipt of the product at RENATTA. & GO.

    On the other hand, and in accordance with article 108.1 of the Consumer and User Law, the User must return the product or products to RENATTA & GO “without any undue delay and, in any case, no later than within 14 calendar days from the date on which you communicate your decision to withdraw from the contract”. You must also assume all direct costs corresponding to the collection of the order to be returned, unless RENATTA & GO has agreed to take charge of said costs.

    On the other hand, and in the case of all those Products that have been made according to the user's specifications, such as any item with a specific name, logo or number, or made according to specific measurements, or any sealed item that is not suitable to be returned for reasons to do with health protection or hygiene and that have been unsealed after delivery (such as, for example, underwear, tights, swimsuits, etc.), RENATTA & GO will not approve the return, in accordance with article 103- “Exceptions to the right of withdrawal” (letters C) and E)) of the Consumer and User Law.

    11. Responsibility and guarantees

    RENATTA & GO does not grant any guarantee nor is it responsible, in any case, for damages of any nature that may arise from access or use of the contents or the Website. Among others, RENATTA & GO is not responsible for the following circumstances, including but not limited to:

    • Loss, damage, retention or delay in delivery of the order due to accidental causes, force of circumstances or acts attributable to the User;

     

    • Delay or retention of the order due to causes attributable to the User, such as, for example, if he/she has not completed their exact and complete details in the registration and account creation form enabled on the RENATTA & GO Website;

     

    • The lack of availability, maintenance and effective functioning of the website and/or its services or contents, excluding, to the maximum extent permitted by current legislation, any liability for damages of any kind that may be due to the lack of availability or continuity of operation of the Website, such as, for example, errors or delays in accessing the Website by the User when entering their details in the order form, the slowness or impossibility of reception by the recipients of the order confirmation or any problem that may arise and that is beyond the good faith of RENATTA & GO;

     

    • The lack of usefulness of the Website or the contents for any service;

     

    • The content of other websites to which links or links inserted on the RENATTA & GO Website may be directed;

     

    • The presence of viruses, malicious or harmful programs on the Website; and

     

    • The illicit, negligent, fraudulent use, that goes against these Terms and Conditions or good faith, of the Website or its content, by the Users, including any infringement of the intellectual and/or industrial property rights of RENATTA & GO or third parties.

    In any case, RENATTA & GO undertakes to solve any problems that may arise and to offer all the necessary support to the User to reach a quick and satisfactory solution to the incident.

    RENATTA & GO reserves the right to cancel an order in the event that it could be suspected that, with the purchase of a product or products, the User's intention is to resell them (such as, for example, in those cases in which the User constantly returns all the orders purchased or in case he/she returns more than half of each of his/her orders).

    Finally, in the event that the User is aware of a breach of third-party rights for matters of intellectual or industrial property regarding some of the products that are made available to the User for purchase, the User may notify or communicate it to RENATTA & GO through the email address customerservice@renattandgo.com so that RENATTA & GO can take the relevant legal and bureaucratic measures to stop said non-compliance.

    12. Intellectual property

    All rights over the content, design and source code of this Website and, in particular, including but not limited to, all rights over photographs, images, texts, logos, designs, brands, trade names, data included on the Website and any other intellectual and industrial property rights are owned by RENATTA & GO, or by third parties who have clearly authorised RENATTA & GO to use them on their Website.

    For this reason and by the requirements of the Royal Legislative Decree 1/1996, of April 12, which approves the consolidated legislation of the Intellectual Property Law, regularising, clarifying and harmonising the current legal provisions on the matter, as well as in Law 17/2001, of December 7th, on Trademarks and complementary legislation on intellectual and industrial property, reproduction, transmission, adaptation, translation, distribution, public communication, including the method of making it available, is clearly prohibited, in whole or in part of the contents of the Website, on any medium and by any technical means, unless clear authorisation is granted in writing by RENATTA & GO.

    RENATTA & GO does not grant any license or authorisation of use of any kind on its intellectual and industrial property rights or on any other property or right related to the Website, and in no case will it be understood that the User’s access and navigation implies a total or partial waiver, transmission, license or assignment of said rights by RENATTA & GO.

    Any use of these contents not previously authorised by RENATTA & GO will be considered a serious breach of intellectual or industrial property rights and will result in liability as stipulated by law.

    13. Protection of personal data

    RENATTA & GO undertakes to process the personal data of its Users according to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27 2016, relating to the protection of individuals with regard to the processing of personal data and the free circulation of these data (GDPR) and Organic Law 3/2018 of December 5, on the Protection of Personal Data and guarantee of digital rights (LOPDGDD).

    In this regard, Users are informed that, in terms of privacy and protection of their personal data, they can exercise the following rights:

    1. Access their personal data;

    2. request rectification of any inaccurate data;

    3. request the deletion of their data;

    4. request for the processing of their data to be limited;

    5. oppose the processing of their data;

    6. exercise the right to be forgotten; and

    7. request the portability of their data. Similarly, Users will have the right to not be subject to decisions based solely on automated data processing.

    14. Modifications

    The information that features on this Website is current as of the date of its last update. RENATTA & GO reserves the right to update, modify or delete the information on this Website, as well as these Terms and Conditions, the privacy policy or any other information.

    The implementation of the modifications to the terms and conditions will occur from the moment of their publication on this Website.

    15. Nullity and effectiveness of the clauses

    If any clause included in these Terms and Conditions were to be declared totally or partially null or ineffective, such nullity or ineffectiveness will affect only said provision or the part thereof that is null or ineffective, with the rest of the clauses subsisting, with such clause, or the part thereof that is affected, being considered not to have been included.

    16. Right of exclusion

    RENATTA & GO reserves the right to deny or withdraw access to the portal and/or the services offered without prior notice, at its own request or that of a third party, to those Users who fail to comply with these Terms and Conditions.

    17. Applicable law and jurisdiction

    These Terms and Conditions are subject to Spanish legislation. The parties, in accordance with Royal Legislative Decree 1/2007, of November 16, which approves the consolidated legislation of the General Law for the Defense of Consumers and Users and other complementary laws, submit to the Courts and Tribunals of the User's place of residence.

    HOW TO USE THE WITHDRAWAL FORM

    If you wish to withdraw from this contract, you must tell us your reasons and return the Product to us within 14 calendar days of receiving your order.

    If you send us the Product past the established deadline, RENATTA & GO will reserve the right to reject the package.

    Below, you can find information about how to exercise the right of withdrawal:

    1. Indicate your intention to return the Product using the form found on the following page. The form must be correctly completed and must be sent to the following address:

    2. Upon receipt of the withdrawal form that you have sent us to the aforementioned address, we will send you the necessary information to return the purchased Product to the email address provided.

    3. Once you receive these documents, the COMPANY's customer service team will contact you to indicate your incident number and how to proceed to make the return.

    4. Once we have received your package in our warehouses or stores, your refund will be made and confirmed by email that will include all the information related to the transaction.
